Terms of Service

These Terms of Service ("Terms") govern your use of the Florida Weather & Tides mobile application ("FWT", "the app", "we", "us", or "our") published by Dean Fletcher. By installing or using FWT, you agree to these Terms. If you do not agree, do not use the app.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, whichever is higher) to use FWT. By using the app you represent that you meet this requirement.
2. Your Account
Some features (such as syncing your Fish Log across devices) require a free account created through Firebase Authentication. You are responsible for:
- Keeping your credentials secure
- All activity that happens under your account
- Notifying us promptly of any unauthorized use
We may suspend or terminate accounts that are used to abuse the service, violate these Terms, or violate any applicable law.
3. License to Use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use FWT on devices you own or control, solely for personal, non-commercial use, subject to these Terms and the terms of the platform you obtained the app from (Apple App Store, Google Play, etc.).
4. Your Content
Fish Log entries, photos, notes, and other content you create in the app ("Your Content") belong to you. You grant FWT a limited license to store, transmit, and display Your Content solely for the purpose of operating the app's sync and display features on your behalf.
You are responsible for ensuring Your Content does not violate the rights of others. We do not pre-screen Your Content, but we may remove content that violates these Terms or applicable law.
5. Acceptable Use
You agree not to:
- Use the app for any unlawful purpose
- Reverse-engineer, decompile, or attempt to extract the source code, except as permitted by law
- Interfere with or disrupt the app's backend services or NOAA's public APIs
- Scrape, replicate, or commercially redistribute data delivered through the app
- Use the app in a way that creates risk of harm to yourself or others
6. Tips and In-App Purchases
FWT may offer optional in-app purchases ("Tips") through the Apple App Store or Google Play. Tips are voluntary contributions to support ongoing development of the app. Tips are non-refundable except as required by the platform's refund policy or applicable consumer-protection law. Tips do not unlock additional features and are not a subscription.
7. Third-Party Data
Weather, tide, and buoy data are provided by the National Oceanic and Atmospheric Administration (NOAA). Boat ramp data is sourced from the Florida Fish & Wildlife Conservation Commission. FWT is not affiliated with, sponsored by, or endorsed by either agency. We do not control these data sources and make no guarantees about their accuracy, availability, or timeliness.
8. Marine Safety Disclaimer
FWT provides information for general planning purposes only. It is not a substitute for:
- Official NOAA marine forecasts
- Navigational charts and the latest Local Notice to Mariners
- Your judgment as captain and operator of a vessel
Conditions on the water can change rapidly. You are solely responsible for your safety and the safety of your crew, passengers, and vessel. Always file a float plan and monitor VHF Channel 16.
9. Intellectual Property
FWT, including its design, source code, branding, and content (other than Your Content and third-party data), is the property of Dean Fletcher and is protected by copyright, trademark, and other laws. These Terms grant you no right to use any of our trademarks, logos, or branding except as expressly authorized.
10. Disclaimer of Warranties
The app is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.
11. Limitation of Liability
To the maximum extent permitted by law, in no event shall Dean Fletcher or FWT be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, personal injury, or property damage — arising out of or related to your use of the app, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the app shall not exceed the greater of (a) the total amount you paid us in the 12 months preceding the claim, or (b) USD $25.
12. Indemnification
You agree to indemnify and hold harmless Dean Fletcher and FWT from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the app, Your Content, or your violation of these Terms.
13. Termination
You may stop using the app at any time. We may suspend or terminate your access to the app or your account if you violate these Terms. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. You agree that any dispute arising from these Terms or the app will be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction there.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by a new "Last updated" date at the top of this page. Your continued use of the app after an update constitutes acceptance of the revised Terms.
